Applicable legal framework

The policy is governed by Article 15 of the Colombian Constitution, Law 1581 of 2012, Decree 1377 of 2013 and External Circular 002 of 2015 of the Superintendence of Industry and Commerce.

Purpose and scope

The policy regulates the procedures used to collect, store, consult, use, circulate, update and delete personal data handled by PA’UE Beach Lounge.

It applies to natural persons recorded in databases related to employees, former employees, candidates, shareholders, suppliers, clients and users, whenever their information is subject to processing.

Processing and permitted uses

Personal information may be processed to provide purchased services, manage commercial and administrative relationships, promote PA’UE activities, complete transactions, prevent fraud, meet accounting obligations and respond to legal or regulatory authorities.

• Clients: service delivery, commercial communications, billing, alliances and contractual compliance.
• Suppliers: commercial administration, accounting, contracting, audits and legally required verification.
• Employees and candidates: recruitment, payroll, benefits, training, labor obligations and maintenance of candidate records.
• Shareholders: dividend payments, communications and legal, tax or regulatory compliance.

Authorization and privacy notice

Data processing requires the holder’s free, express and informed consent. Authorization may be obtained through a signed physical or digital document, a clearly identified checkbox in a digital form or another mechanism that allows PA’UE to retain proof of consent.

The privacy notice identifies the controller, the information collected, its purposes and the mechanisms available to exercise data rights.

Rights of data holders

• Know, update and correct personal information.
• Request evidence of the authorization granted.
• Be informed about how personal data has been used.
• Submit complaints before the Superintendence of Industry and Commerce.
• Revoke authorization or request deletion when legally permitted.
• Access personal data free of charge.

Access, inquiries and claims

Data holders and their successors may consult the information held in PA’UE databases. Inquiries are answered within a maximum of ten business days, and claims within a maximum of fifteen business days, under the procedure established by Colombian law.

Children and adolescents

Any processing of information belonging to children or adolescents must respect their best interests, protect their fundamental rights and consider their opinion according to their maturity and autonomy.

Security, revocation and validity

PA’UE applies technical, human and administrative safeguards intended to prevent loss, alteration, unauthorized consultation or fraudulent access. Authorization may be revoked in whole or in part when legally permitted and the scope of the request is clearly stated.

The policy is effective from publication and remains valid for as long as required by the purposes inherent to the legal and commercial activity of INVERSIONES LA CHAMPETUA SAS – PA’UE Beach Lounge.
